The Platform is owned and operated by MEDSOAMERICA, INC.(“Company”), having its registered office at P.O. Box 397, Statesboro, Georgia 30459, USA (the “Company”, “we”, “us”, “our''). Anybody visiting or using this Platform is a “user”.

By visiting and/or using the Platform, you agree to the terms of this Privacy Policy and it shall be deemed that you have read in full, accepted and agreed to the terms herein. The Company reserves the right to modify the terms contained in this Privacy Policy at any time by posting such modifications on the Website. The modified Privacy Policy would be effective from the date of modification that is posted by the Company on the Website and effective as soon as it is accessible by the user. If you do not agree to any term that is contained in this Privacy Policy, please immediately cease your use of the Platform. Information that is collected by the Company on the Platform shall be used by the Company only for the purpose of providing the Services (as defined hereinafter), and such information shall not be used, sold, transferred or rented in a manner that is not set out in this Privacy Policy. This privacy policy applies to all information collected through our website (such as www.uscanceropinion.com), mobile application, ("Apps"), and/or any related services, sales, marketing or events (we refer to them collectively in this privacy policy as the ("Services"). We encourage you to review this privacy policy frequently to be informed of how we are protecting your information.

What Information Do We Collect?

In providing the various services that are available on the Platform (the “Services”), the Company may have to collect certain personal information from you. This information would, inter alia, include the following:

Contact information: the Company may collect your name, date of birth, gender, email id, mobile number, postal address, your local doctor name and phone number, local doctor hospital name, hospital address, etc.

Information to provide the Services: the Company may collect information regarding your medical history, medical reports, details of medication taken, health condition, prescriptions, allergies, age, body weight, family medical history etc. in order to provide the Services in an efficient manner.

Payment and billing information: The Company may collect your billing name, billing address and payment method when you pay for the Services availed by you on the Platform through payment gateway ( Please note that the Company would collect your credit/debit card number or credit/debit card expiry date or other details pertaining to your credit/debit card. Credit/debit card information will be obtained and processed by our online payment partners Stripe.com)

Other information: While you use the Platform, the Company may collect information about your IP address and the browser you are using.

 

You acknowledge and agree that any and all information that is provided by you on the Platform is provided by you voluntarily and at your own risk. While the Company would make all efforts to ensure the safety and security of the information provided by you, it shall not be responsible for any loss or theft of data. Please note that any information that is provided by you may be retained by the Company for (i) providing the Services; and (ii) for meeting its obligations under applicable law. Even if you delete your User account on the Platform, the Company may have to retain the information provided by you for a short period of time until the same can be erased from its servers, and for compliance with its obligations under applicable law (if any).

You shall be responsible for the accuracy of the information provided to the Company for the use of the Platform and the Services. If there is any mistake in or change to the personal information provided by you for the use of Platform, you shall immediately notify the Company at notice@uscanceropinion.com . You shall be solely liable for the consequences of providing incomplete, inaccurate or incorrect information on the Platform. Where the Company has reasons to believe that the information provided by you on the Platform is incorrect or incomplete, the Company may restrict you from using the Platform by disabling your User Account.

The Platform is not directed at minors, and we do not seek to collect any information from children including those under the age of 18. If we learn that we have received any information from an individual under the age of 18, we will use that information only to respond directly to the minor (or a parent or legal guardian) to inform him or her that he or she cannot use the Services and subsequently we will delete that information from our own servers.

If you want to discontinue the use of the Platform, or if you want to withdraw the consent granted to the Platform for collecting and processing your data, please notify the Company at notice@uscanceropinion.com . Once you discontinue the use of the Platform or withdraw your consent, the Company shall retain the personal information provided by you on the Platform for such time period as may be mandated by applicable law (if any) and thereafter erase the same in full.

Information Collected

We collect personal information that you voluntarily provide to us when registering at the Services or Apps, expressing an interest in obtaining information about us or our products and services, when participating in activities on the Services or Apps or otherwise contacting us, while availing of the Services through the Platform, while making payments using the payment gateway on the Platform etc. We also collect information that is gathered by the Company using tracking tools like Google Analytics, Google Webmaster, browser cookies etc. for collecting information about your usage of our Platform. This information may be used by the Company for internal research to understand User demographics, interests and behaviour with a view to improving the functionality of the Platform, track your preferences, to provide you with a customized Platform experience, to notify you of any updated information and new services and other related functions offered by the Platform/ Company, keep you informed about latest content available on the Platform, special offers, and other products and services of the Company, to assist you with customer service or technical support issues and so on.

While the Company does not actively collect any information from persons who visit the Platform, and do not register themselves on it or avail of the Services, certain portions of this Privacy Policy would be applicable to such visitors as well. Some information — such as IP address and/or browser, and device characteristics — is collected automatically when you visit our Services or Apps. This information does not reveal your specific identity (like your name or contact information) but may include device and usage information, such as your IP address, browser and device characteristics, operating system, language preferences, referring URLs, device name, country, location, information about how and when you use our Services or Apps and other technical information. If you use our Apps, we may also collect the following information: Geo-Location Information. We may request access or permission to track location-based information from your mobile device, either continuously or while you are using our mobile application, to provide location-based services. If you wish to change our access or permissions, you may do so in your device's settings.

Mobile Device Data. We may automatically collect device information (such as your mobile device ID, model, and manufacturer), operating system, version information and IP address. Push Notifications. We may request to send you push notifications regarding your account or the mobile application. If you wish to opt-out from receiving these types of communications, you may turn them off in your device's settings.

How do we use your Information

To contact you: The contact information you provide would be used by the Company to contact you in relation to the provision of the Services.

To improve the quality of the Services: The Company might use your information to improve the functionality of the Services and to ensure that its quality is maintained / bettered. Security of your Information

Please note that neither the Company nor any of its employees, contractor, agent would have access to the password that relates to your User account on the Platform. You shall be solely responsible for protecting your login credentials to the Platform, and the Company shall not be liable in any manner for unauthorised use of your login credentials. You shall be liable to the Company for any loss suffered by the Company as a result of unauthorised use of your login credentials. In the event of any misuse or suspected misuse of the same, please notify the Company at notice@uscanceropinion.com . While the Company shall seek to implement the best market practices and security policies for the protection of your personal information, it shall not be liable for improper use or disclosure, unauthorised modification and unlawful destruction or accidental loss of information. It is expressly stated that the Company shall not be responsible for any breach of security or for any actions of any third parties that receive Users' personal data or events that are beyond the reasonable control of the Company including, acts of government, computer hacking, unauthorized access to computer data and storage devices and storage technology, hardware, computer crashes, breach of security and encryption etc.

We have implemented appropriate technical and organizational security measures designed to protect the security of any personal information we process. However, please also remember that we cannot guarantee that the internet itself is 100% secure. Although we will do our best to protect your personal information, transmission of personal information to and from our Services or Apps is at your own risk. You should only access the services within a secure environment.

A privacy breach occurs when there is unauthorized access to or collection, use, disclosure or disposal of personal information. You will be notified about data breaches when the Company believes you are likely to be at risk or serious harm. For example, a data breach may be likely to result in serious financial harm or harm to your mental or physical well-being. In the event that Company becomes aware of a security breach which has resulted or may result in unauthorized access, use or disclosure of personal information Company will promptly investigate the matter and notify the applicable Supervisory Authority not later than 72 hours after having become aware of it, unless the personal data breach is unlikely to result in a risk to the rights and freedoms of natural persons.

Cookies: A cookie is a small file which asks permission to be placed on your computer's hard drive. Once you grant the permission, the file is added and the cookie helps analyze web traffic or lets you know when you visit a particular site. The Company uses traffic log cookies to identify which pages are being used. This helps the Company analyze data about web page traffic and improve the functioning of the Platform. This information is used by the Company only for statistical analysis and then the data is removed from the system. Please note that the Company does not have any control over the cookies that are placed by third party links on the Platform. If you click on one of the links to third party websites that may be available on the Platform, you may be taken to websites that the Company does not control. This Privacy Policy does not apply to the privacy practices of those websites. The Company shall not be liable for the misuse of your personal information by third party websites. The Company may, going forward and at its sole discretion, use third-party advertising companies to serve ads when a User visits the Platform. These companies may use information (not including your name, address, email address, or telephone number) about your visits to this and other websites in order to provide advertisements about goods and services of interest to you.

Your Privacy Rights

In some regions (like the European Economic Area), you have certain rights under applicable data protection laws. These may include the right (i) to request access and obtain a copy of your personal information, (ii) to request rectification or erasure; (iii) to restrict the processing of your personal information; and (iv) if applicable, to data portability. Account Information

If you would at any time like to review or change the information in your account or terminate your account, you can contact us at notice@uscanceropinion.com with that request in writing and reason for that request. Upon your request to terminate your account, we will deactivate or delete your account and information from our active databases. However, some information may be retained in our files to prevent fraud, troubleshoot problems, assist with any investigations, enforce our Terms of Use and/or comply with legal requirements.

Redressal of Grievances

If a User has any questions or grievances regarding the Platform, the contents thereof, the manner in which personal data is being collected or processed by the Platform or regarding the Services, the User may reach out to The Grievance Officer of the Company customer support at notice@uscanceropinion.com (the “Grievance Officer”). The Grievance Officer shall address any complaint or grievance that is raised by a User within a period of one (1) month from when it is raised. Where the Company requires additional information to process and respond to the query raised by a User, the Company shall notify the User of the same.

Miscellaneous Provisions

Notices: All notices given to a User by the Company or by a User to the Company or another User shall be in writing and in the English language. Such notice shall be sent by e-mail or mailed by a prepaid internationally-recognized courier service to the intended recipient at the address set out below, or any changed address that is notified by either Party:
